Tooting Fish and Kebab

These Terms and Conditions (“Terms”) govern your use of the Tooting Fish and Kebab mobile app and website (together, the “Service”) and any orders you place through them. By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About us
Tooting Fish and Kebab runs a food ordering and delivery service. You can reach us at:

2. Eligibility and your account
- You must be at least 16 years old to use the Service and create an account. By creating an account, you confirm that you meet this requirement.
- You are responsible for keeping your login details secure and for all activity that takes place under your account.
- You agree to give us accurate, current and complete information — including your name, contact details and delivery address — so we can fulfil your orders.
- We may suspend or close your account if you break these Terms or misuse the Service.
3. The app licence
The app is licensed to you, not sold. We grant you a personal, non-transferable, non-exclusive licence to use the app on any device that you own or control, solely for your own use and in line with these Terms and the usage rules of the app store you downloaded it from.
Your download and use of the app is also subject to the terms of that app store (the Apple App Store or Google Play). Where those store terms conflict with these Terms in relation to your use of the app, the store terms apply to that extent. Additional store-specific terms are set out in Section 15.
4. Placing an order
- An order you place through the Service is an offer to buy the items in your basket.
- We accept your order only when we confirm it — for example, by showing a confirmation in the app or sending you a notification. A contract between you and us is formed at that point.
- We may refuse or cancel an order — for example, if an item is unavailable, if there is a pricing or description error, if we cannot deliver to your address, or if we suspect fraud. If we cancel an order you have paid for, we will refund you.
- Menu items, availability and opening hours may change without notice.
5. Prices and payment
- All prices are shown in pounds sterling (GBP) and include VAT where applicable.
- Prices may include delivery fees, service charges or minimum order requirements. These are shown before you confirm your order.
- Payment is taken when you place your order, through our secure payment provider, Stripe. We do not store your full card details.
- You confirm that you are authorised to use the payment method you provide.
- We work hard to keep prices accurate. If we find a pricing error after you order, we will contact you so you can either reconfirm at the correct price or cancel for a full refund.
6. Delivery and collection
- We will make reasonable efforts to deliver within any estimated time shown, but delivery times are estimates only and are not guaranteed. Delays can happen because of weather, traffic, demand and other factors outside our control.
- You must give an accurate delivery address and be available to receive your order. If we cannot reach you or access the address, your order may be treated as delivered and no refund may be due.
- Some orders may be available for collection from the restaurant. If so, it is your responsibility to collect within the stated time.
- Risk in the food passes to you on delivery or collection.
7. Cancellations and refunds
- Because our food is freshly prepared and perishable, you do not have a general right to cancel once we have started preparing your order. This reflects the exception for perishable goods under the Consumer Contracts Regulations 2013.
- If you want to cancel, contact us as soon as possible. We may be able to cancel if preparation has not yet started.
- If your order is wrong, has missing items, or is of unsatisfactory quality, please contact us promptly so we can put it right. Depending on the circumstances, we may offer a replacement, a partial refund or a full refund.
- Refunds go to your original payment method and may take a few business days to appear, depending on your bank or card provider.
8. Food information and allergies
- We provide allergen and ingredient information where we can, but our food is prepared in kitchens that handle common allergens — including nuts, gluten, dairy, eggs, fish, shellfish and others. We cannot guarantee that any item is completely free from any allergen.
- If you have a food allergy or intolerance, please contact us before ordering. You are responsible for checking that food is suitable for you.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or harmful purpose;
- Place orders you do not intend to pay for or receive;
- Interfere with, damage or disrupt the Service or its security;
- Attempt to gain unauthorised access to any part of the Service or to other users’ accounts;
- Abuse, threaten or harass our staff or delivery riders.
We may suspend or end your access if you breach this section.
10. In-app messaging and objectionable content
The Service includes in-app messaging — for example, chat with our support team or with a delivery rider about your order. When you use these features, you agree not to send or post content that is unlawful, abusive, harassing, threatening, defamatory, obscene, or otherwise objectionable.
We operate a zero-tolerance policy for objectionable content and abusive behaviour. You can report objectionable content or an abusive user by emailing info@tootingfishkebab.co.uk. We review reports and take appropriate action — which may include removing content and suspending or removing the user responsible — within 24 hours.
11. Notifications and communications
By using the Service, you agree that we may send you communications about your orders and account, such as order updates and delivery notifications. You can manage push notifications and location permissions in your device settings.
12. Intellectual property
All content in the Service — including our name, logo, branding, text, graphics and software — belongs to us or our licensors and is protected by intellectual property laws. You may not copy, reproduce or use it without our permission.
13. Our liability
- We provide the Service with reasonable care and skill, but we do not guarantee that it will always be uninterrupted or error-free.
- We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
- We do not exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, for fraud, or for your legal rights in relation to food that is faulty or not as described.
- To the extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order.
Nothing in these Terms affects your statutory rights as a consumer.
14. Privacy

15. App store terms
Apple App Store
If you downloaded the app from the Apple App Store, the following applies. These Terms are between you and us only, not with Apple, and Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims relating to the app or your use of it — including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, claims under consumer protection or similar law, and intellectual property claims.
- You confirm that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.
Google Play
If you downloaded the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app or your orders.
16. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available in the app and on our website, with the “Last updated” date shown above. If you keep using the Service after changes take effect, you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
